By using the Dukanak platform (whether as a merchant opening a store on it or a visitor to any store hosted on it), you agree to these Terms & Conditions in full. Please read them carefully before using the platform.
1. Definition of the Service
"Dukanak" is a technology (SaaS) platform that lets anyone create and manage their own online store: listing products, receiving orders, managing inventory and customers, and customizing the store's appearance. Dukanak is solely the technology and infrastructure provider, and is not a party to the sales transactions between a merchant and their customers.
"Merchant" below means anyone who created an account on Dukanak to open an online store on it. "User" includes the merchant and any visitor or customer browsing a store hosted on the platform.
2. Account & Registration
- Your registration details (name, email, phone number) must be accurate and kept up to date.
- You are responsible for keeping your login credentials (password, two-factor codes) confidential and for all activity on your account.
- You must be 18 years or older to open a store and enter a paid subscription on the platform. A minor requires a guardian's consent.
- Dukanak may suspend or cancel any account that provides misleading information or impersonates another party.
3. Plans, Subscription & Payment
- Plans and their prices are clearly shown on the "Pricing" page, and are calculated in Jordanian Dinar unless stated otherwise.
- Your subscription renews automatically according to the chosen billing cycle (monthly or yearly) unless you cancel it before the end of the current period.
- Your store remains in "preview" mode, hidden from visitors, until your first subscription payment is completed successfully.
- Failure to renew or a delayed payment will temporarily hide your store from visitors, while your data is fully preserved for later reactivation.
- Plan prices are subject to change in the future; any change applies to upcoming renewal cycles and not retroactively to an already-paid period.
4. Free Trial, Cancellation & Refunds
Dukanak may offer a free trial period for some plans, with its duration and terms shown at signup. You may cancel your subscription at any time from the "My Subscription" page; your store will keep working until the end of the current paid period, then stop being visible to visitors without deleting its data.
Fees paid for an active subscription period are non-refundable except where required by Jordanian law, or at Dukanak's discretion in exceptional cases (such as a documented technical error on our part that prevented you from using the service).
5. Merchant Responsibilities
As a merchant on the platform, you are solely responsible for:
- The accuracy of your store's information, products, prices, and product images.
- Complying with any licenses or business registrations required by Jordanian law for your specific commercial activity — Dukanak does not issue or guarantee any business license for you.
- Fulfilling orders (shipping, delivery) and handling return and cancellation requests from your customers according to your store's published policy and applicable law.
- Protecting the customer data you collect through your store and complying with Jordan's Personal Data Protection Law No. (24) of 2023 when processing it.
- Paying any taxes or fees due on your sales under Jordanian law.
6. Products & Prohibited Content
Using Dukanak to sell or promote any of the following is prohibited:
- Goods or services that violate Jordanian law (narcotics, unlicensed weapons, counterfeit goods, or goods that infringe intellectual property rights).
- Pornographic content, content that exploits minors, or content that incites violence, hatred, or discrimination.
- Financial fraud schemes, pyramid/multi-level marketing, or unlicensed financial services (lending, unlicensed cryptocurrency).
- Any content that infringes a third party's rights (text, image, trademark) without their permission.
Dukanak may remove any violating product or content and suspend the offending store immediately without prior notice in cases of serious violation or potential harm to users or the platform.
7. Dealings With the Merchant's Customers
The sales contractual relationship (price, quality, shipping, returns) arises directly between the merchant and their customer. Dukanak is not a party to this contract and bears no responsibility for any dispute between a merchant and their customer regarding a product or order, though it may intervene administratively (such as suspending a repeatedly-reported merchant's account) to protect the platform's integrity.
8. Custom Domains & Intellectual Property
- Your store's content (your text, images, logo) remains your property. You grant Dukanak a non-exclusive license to display and store it solely for the purpose of operating your store on the platform.
- The Dukanak platform's source code, dashboard design, and the ready-made themes provided are Dukanak's property and may not be copied or redistributed.
- Connecting a custom domain to your store is your responsibility in terms of registering and renewing it with a domain provider; Dukanak provides only the technical connection mechanism.
9. Availability & Maintenance
We make reasonable efforts to keep the platform available around the clock, but we do not guarantee absolutely uninterrupted operation. Scheduled maintenance periods or unexpected technical issues may occur, which we work to resolve as quickly as possible.
10. Limitation of Liability
The platform is provided "as is" without express or implied warranties of being entirely error-free. Dukanak bears no responsibility for any loss of profit, data, or indirect damages arising from use of the platform, to the fullest extent permitted by Jordanian law. Dukanak's total liability toward any merchant, if any, is limited to the amount that merchant paid during the three months preceding the incident.
11. Termination & Account Suspension
You may close your account at any time from account settings or by contacting us. Dukanak may suspend or terminate any account that violates these terms, with prior notice where possible, except in cases of serious violations (fraud, prohibited content, harm to the platform or other users) where suspension may be immediate.
12. Changes to These Terms
We may update these terms from time to time to keep pace with the service's development or legislation. We will notify you of any material change via email or an in-dashboard notice before it takes effect. Continuing to use the platform after the change constitutes acceptance of it.
13. Governing Law & Dispute Resolution
These terms are governed by and interpreted according to the laws of the Hashemite Kingdom of Jordan. Any dispute arising from use of the platform is subject to the jurisdiction of the courts of Amman, without prejudice to your right to resort to any other dispute resolution body provided for by law.
